Farm owner blames crop losses on irrigation, filtration company

FRESNO — A Fresno farm owner is suing an irrigation and filtration company, alleging negligence and product liability caused crop damage.

Anthony F. Simone, doing business as Simone Farms filed a complaint Oct. 23 in Fresno County Superior Court against Agri-Valley Irrigation LLC, Agri-Valley Irrigation Inc., AVI Investments Inc., Larry Rompal and Does 1-20, alleging they breached their duty of good faith and fair dealing.

According to the complaint, on June 28, 2012, Simone contracted with the defendants for a redesign/upgrade of the previous irrigation and filtration system on the farm at Garfield and Gettysburg in Fresno that they initially manufactured and installed in 2008. However, Simone Farms says it suffered crop and profit losses and has expended money in attempting to remedy the design defect and substandard work of the defendants. 

The plaintiff alleges the defendants failed to effectively filter sand and dirt particles, and caused decreased water flow rates and under-watered trees.

Simone Farms seeks trial by jury, damages of at least $200,000, plus $50,000 for the remedy of the defendants' defective work, attorney fees, cost of suit and all further relief the court deems proper. The plaintiff is represented by attorney C. Russell Georgeson of Georgeson and Belardinelli in Fresno.
