State Farm alleges motorist refuses to pay $25,000 claim

FRESNO — State Farm is suing a Fresno County motorist, alleging refusal to pay for damages after causing a vehicular collision.

State Farm Mutual Automobile Insurance Company filed a complaint Oct. 26 in Fresno County Superior Court against Herbert Goodwin, and Does 1-40, alleging the defendants operated a vehicle in a careless manner, causing a collision, personal injuries and property damage to an insured client.

According to the complaint, on June 19, 2016, State Farm's insured client, Jodi Pruitt, suffered damages after a vehicle collision caused by Goodwin on state Route 41 near Laton. The suit says Pruitt filed for insurance motorist coverage. State Farm alleges it has performed its obligation by paying the sum of $25,560.72 as coverage to Pruitt but has failed to receive payment from the defendants as subrogation. 

The plaintiff alleges the defendants have failed to pay the subrogation fees for property damages and personal injury after causing a vehicular collision.

State Farm Mutual Automobile Insurance seeks trial by jury, judgment for $25,560.72, plus pre-judgment interest, costs of suit, and all other relief the court deems just and proper.
