FRESNO — A Fresno County woman is suing General Motors, alleging breach of implied warranty and breach of warranty involving the purchase of a 2012 Chevrolet Cruze.
Jennifer Lynn Rodriguez of Clovis filed a complaint Nov. 1 in Fresno County Superior Court against General Motors LLC and Does 1-10, alleging they breached their duties of good faith and fair dealing.
According to the complaint, on Oct. 18, 2013, Rodriguez purchased the 2012 Chevy Cruze. The suit says the vehicle was delivered to her with serious defects and non-conformities to warranty and later developed other serious problems including engine defects.
The plaintiff alleges the defendants breached the express and implied warranties by failing to repair the defects and non-conformities, or to replace or repurchase the vehicle.
Rodriguez seeks trial by jury, general, special and actual damages, rescission of the purchase contract and restitution of all monies expended, incidental and consequential damages, civil penalty, interest, attorney fees, costs of suit, and all further relief the court deems proper.
