FRESNO — A Fresno property owner is suing her co-owner of three properties, alleging breach of contract.

Mariana Melendez filed a complaint Nov. 2 in Fresno County Superior Court against John D. Kinsfather, and Does 1 to 50, alleging breach of contract agreement by failing to assume the debt.

According to the complaint,  between April 2006 and Sept. 30, 2013,  Melendez in a long-term personal relationship with Kinsfather. The suit says she recorded a deed of trust of their three Fresno properties when the relationship ended. 

The lawsuit states Melendez performed her duties of deed to the properties and defendant was to personally assume the secured debts. Melendez says she is still liable for the three deeds of trust and is unable to purchase a home due to these liabilities. 

The plaintiff alleges the defendants have failed to assume debts and defaulted on the deed of trust payments, harming the credit of others.

Melendez seeks trial by jury, damages in an amount to be proven at trial, costs of suit, attorney fees, cancellation the grant deeds and all other relief the court deems proper. She is represented by attorney Mike Chappars of Law Office of Robert C. Abrams in Fresno.
