SAN DIEGO — A disabled man who requires a wheelchair is suing El Cajon property owners, alleging disability discrimination and failure to uphold Americans with Disabilities Act regulations.
Chris Langer filed a complaint Nov. 24 in U.S. District Court for the Southern District of California against Shirley A. Goward, Esho Inc. and Does 1-10, alleging they failed to provide full and safe equal access to its facilities.
According to the complaint, in October, Langer was on defendants' property, 665 E. Main St., El Cajon, to shop at Sam's International Market and Kitchenware store. The suit says Langer suffered difficulty and frustration by being denied an accessible parking lot for his van and other barriers that prevented him to visit the store, both then and in the future.
The plaintiff alleges the defendants interfered with his right to travel free of discrimination, failed to design and construct an ADA-compliant premises and failed to make reasonable modifications in policies, practices, or procedures.
Langer seeks trial by jury, injunctive relief, actual and statutory damages at a minimum of $4,000, attorney fees, litigation expenses and costs of suit. He is represented by attorney Isabel Masanque of Center for Disability Access in San Diego.
