LOS ANGELES — An Agoura Hills, California, clothing corporation is suing a Texas competitor, alleging trademark infringement and unfair competition.
Barefoot Dreams Inc. filed a complaint Dec. 4 in U.S. District Court for the Central District of California against Grace and Lace LLC and Does 1-X, alleging violation of the United States Trademark Act.
According to the complaint, in 2014, Barefoot Dreams became the sole owner of the rights for LUXE+ as a clothing line to be marketed and sold to the public. Barefoot Dreams alleges Grace and Lace continues to manufacture, advertise and sell women's wear apparel with the same design as the plaintiff's trademark LUXE+ products.
As a result, Barefoot Dreams says this will likely cause confusion or mistakes or deceive purchasers as to the source of origin of the clothing products.
The plaintiff alleges Grace and Lace continues to use false and misleading descriptions of fact and representations that are likely to give the public a false impression and bring confusion as to the source of its clothing goods.
Barefoot Dreams seeks trial by jury, require Grace and Lace to destroy all control bearing the mark LUXE, exemplary damages of $100,000, costs of suit, attorney fees and all other relief the court deems equitable.
