Architect alleges debt collector owes more than $100,000

FRESNO — A Berkeley architect is suing a law firm, alleging it owes more than $100,000 for breach of contract.

Ron Bogley filed a complaint Nov. 28 in Fresno County Superior Court against Glendale Acceptance LLC, Jeff Allan, Kathryn Lauer and Does 1 to 10, alleging the defendants breached a contract agreement by not performing their agreed duties to pay the assignor the 85 percent of the collected debt amount.

According to the complaint, on Feb. 24, Bogley agreed to sign a written agreement with Glendale Acceptance wherein he would receive 85 percent of the collected debt from Karl Reeh, for whom Bogley had performed architectural services, after the defendants agreed to be the collector of the debt. 

Bogley alleges the agreement was acknowledged repeatedly by the defendants and the plaintiff performed all required acts under the agreement but failed to receive his 85 percent share, amounting to $25,587.78. 

The plaintiff alleges the defendants failed or refused to perform their agreed duties to pay the assigner the 85 percent of the collected amount after expiration of 90 days.

Bogley seeks trial by jury, damages of $25,587.88 with interest, exemplary damages of $73,406.60, amounts due under the contract of $23,808.20, costs of suit, attorney fees and all other relief the court deems just. He is represented by attorney Peter H. Liederman of Law Office of Peter H. Liederman in Berkeley.
