Fresno County property owner alleges fraud

FRESNO — An elderly Fresno County man is suing three defendants, alleging elder abuse, breach of contract, and fraud.

Henry Jimenez, who is older than 65, filed a complaint Dec. 1, in Fresno County Superior Court against Dora Marmolejo Duarte, Daniel Duarte, Mariscos Costa Azul Inc. and Does 1-20, alleging they owe him $20,000. 

According to the complaint, on Nov. 16, 2016, Jimenez was harmed by the malicious conduct of the defendants of inducing him to turn over $20,000 to them to purchase propertyat  2132 Carson Ave., Clovis, without the intention of returning back his funds. 

The plaintiff alleges the defendants failed to make timely payments as agreed upon, appropriated Jimenez's funds with intent to defraud, and continued to use and benefit from the funds wrongfully acquired from plaintiff.

Jimenez seeks trial by jury, compensatory damages of at least $20,000, costs incurred, attorney fees, court costs, andall  further relief the court deems just. He is represented by attorney Joseph A. West of The Law Office of Joseph A. West in Fresno.
