Parents blame drunk motorist for causing sons's death

FRESNO — Two parents are suing a motorist and others, alleging negligence and drunk driving caused the death of their son.

Timothy M. Whittington and Melissa Barefoot filed a complaint Dec. 12, in Fresno County Superior Court against Brokton George Bakman, Richard Bakman, Penelope Bakman and Does 1-25, alleging negligence. 

According to the complaint, on March 3, 2017, Joseph Sheppard Whittington was walking on Shaw Avenue, 310 feet east of Marty Avenue in Frenso when he was struck and killed by a car driven by Brokton George Bakman. The suit says the plaintiffs suffered damages, including hospital and funeral expenses and the loss of the care and services of their adult child, from his wrongful death as result of the negligent operation of a vehicle by Bakman.  

The plaintiffs allege Brokton George Bakman consumed alcohol and/or other intoxicating substances prior to operating the motor vehicle, and that Richard Bakman, and Penelope Bakman allowed an intoxicated individual to operate a motor vehicle.

The plaintiffs seek trial by jury, compensatory and punitive damages of more than $25,000, costs of suit, and all fair and just relief. They are represented by attorney David L. Milligan of Law Office of David L. Milligan in Fresno.
