Consulting firm alleges customer owes more than $22,000

FRESNO — A Clovis company is suing a customer, alleging breach of contract.

First Resource Consulting LLC, formerly known as Federal Reo Consulting LLC, filed a complaint Dec. 12 in Fresno County Superior Court against Jonathan Gineo of Bethel, Connecticut, and Does 1-100, alleging they breached good faith and fair dealing by failing to pay more than $22,000.

According to the complaint, on Dec. 14, 2015, First Resource Consulting entered in a written agreement with Gineo to provide access to a proprietary and confidential program. The suit says the defendants breached the service agreement by failing to pay the plaintiff a service fee equivalent to 17 percent of the total gross compensation earned from listing commissions and other earned income arising out of the agreement.  

The plaintiff alleges the defendants interfered with First Resources' right to receive the benefits of the service agreement by failing and refusing to remit monies to the plaintiff pursuant to the terms of the agreement, and have refused to provide an accounting of the listing commissions and other earned income.

First Resource Consulting seeks trial by jury, an award of the service fee for $22,903.87, interest, late fees, court costs, attorney fees, exemplary and punitive damages, and all other relief the court deems just. They are represented by attorney Matthew W. Quall of Quall Cardot LLP in Fresno.
