Fresno transport company accuses competitor of trade name infringement

FRESNO — A Fresno transport company is suing a competitor, alleging trade name infringement.

Gust Transportation Inc. filed a complaint Dec. 11 in Fresno County Superior Court against Jeffrey Gust, J Gust Transportation Inc., JG Transportation LLC and Does 1-20, alleging that they obtained profit through the use of infringing trademarks.

According to the complaint, in January 2017, Gust Transportation learned the defendants have been using its trade name without authority. The suit says the defendants have refused to cease this wrongful act despite being notified of Gust Transportation's trade name rights.

The suit says the defendants' illegal actions have caused the plaintiff to suffer damages to its business, reputation and good will and the loss of sales and profits it would have made but for the defendants' infringing actions. 

The plaintiff alleges the defendants caused confusion among consumers by using the same marks as Gust Transportation's distinctive marks, and capitalized and received the benefit of the plaintiff's reputation and good will.

Gust Transportation seeks, trial by jury, injunctive relief, punitive damages of $100,000, costs of action, attorney fees, statutory damages, and all further relief the court deems just. It is represented by attorney Yan E. Shrayberman of Law Offices of Yan E. Shrayberman in Fresno.
