Policy holder accuses insurer of violating ERISA

LOS ANGELES — A policy holder is suing an insurance company, alleging violation of the Employee Retirement Income Security Act (ERISA).

James Remedes filed a complaint Jan. 3 in U.S. District Court for the Central District of California against Sun Life Financial Assurance Company of Canada (U.S.) and Bobrick Washroom Equipment Inc.'s Long Term Disability Plan, alleging they violated ERISA through non-payment of plan benefits.

According to the complaint, Remedes was an employee for Bobrick when he suffered a disability. The suit says on Nov. 17, 2017, Remedes suffered damages from the defendants' wrongful action to uphold its decision to deny the plaintiff's claim for long-term disability benefits. 

The plaintiff alleges the defendants failed to pay long-term disability benefit payments to Remedes, failed to provide a prompt and reasonable explanation for the denial of his claims, and failed to properly investigate and provide a full review of the merits of Remedes' disability claim.

Remedes seeks trial by jury, disability benefits, court costs, attorney fees, interest and all further relief the court deems just. He is represented by attorney Andrew M. Kantor of Kantor & Kantor LLP in Northridge.
