Disabled man accuses Los Angeles restaurant of disability discrimination

LOS ANGELES — A disabled man is suing a Los Angles coffee shop, alleging disability discrimination.

Francisco Garcia filed a complaint Jan. 8 in U.S. District Court for the Central District of California against Food & Family LLC, doing business as Nong La Cafe, and Does 1 through 10, alleging violation of the Americans with Disabilities Act and California's Unruh Civil Rights Act.

According to the complaint, on April 4, 2017, Garcia, who requires a wheelchair, went to Nong La Cafe, 2055 Sawtelle Blvd., Los Angeles, which is open to the public. During his visit, Garcia says, he encountered barriers that interfered with his ability to use and enjoy the goods, services, privileges and accommodations offered at the restaurant, including use of the restroom. He also alleges the defendants knew that particular barriers render the business inaccessible to physically disabled individuals suchas Garcia. 

The plaintiff alleges Nong La Cafe failed to make reasonable modifications in policies, practices or procedures when such modifications are necessary by law, and failed to remove architectural barriers and communication barriers to disabled persons.

Garcia seeks trial by jury, preliminary and permanent injunction, all appropriate damages of at least $4,000, attorney fees, litigation expenses, costs of suit, prejudgment interest and all other relief the court deems just and proper. He is represented by attorney Jason Yoon of So. Cal. Equal Access Group in Los Angeles.
