Former school district employee accuses plan administrator of violating ERISA

FRESNO — A Tulare County woman is suing an insurance company, alleging violation of the Employee Retirement Income Security Act (ERISA).

Yvette L. Jaquish, a former employee of the Potersville Unified School District, filed a complaint Jan. 18 in U.S. District Court for the Eastern District of California Fresno Division against The Standard Insurance Company and Does 1-100, alleging they violated ERISA through non-payment of plan benefits.

According to the complaint, on Aug. 18, 2017, Jaquish suffered economic injury from the defendants' wrongful act of upholding a prior determination to deny the plaintiff's claim for disability benefits, which she sought based on her pregnancy and the upcoming birth of her child . 

The plaintiff alleges the defendants failed to pay benefits against the terms of the insurance plan, failed to provide a prompt and reasonable explanation for the denial of benefits, and failed to adequately investigate the merits of Jaquish's disability claim.

Jaquish seeks trial by jury, payment of disability benefits, penalties, court costs, attorney fees, interest and all further relief the court deems just. She is represented by attorney Allan Bailey of Krase, Bailey, Reed-Krase LLP in Porterville.
