Equity Asset & Property Management Inc. alleged to have unlawfully used photo

SAN DIEGO – A Colorado-based travel photographer alleges a luxury real estate investment company used his photograph without permission.

Blaine Harrington III filed a complaint on Jan. 30 in the U.S. District Court for the Southern District of California against Equity Asset & Property Management Inc., doing business as Equity Residences LLC, alleging copyright infringement.

According to the complaint, the plaintiff alleges that the defendant copied his copyrighted photograph of a beach in order to advertise its business.

The plaintiff holds Equity Asset & Property Management Inc. responsible because the defendant allegedly used his work without permission or license.

The plaintiff requests a trial by jury and seeks judgment against the defendant, award actual damages, statutory damages, attorneys’ fees, costs of suit and further relief as the court deems just. He is represented by Jonah A. Grossbardt of Schneider Rothman Intellectual Property Law Group PLLC in Los Angeles.
