By Noddy A. Fernandez | Feb 8, 2018

SACRAMENTO – A Bakersfield tank and related equipment rental business alleges a competitor is using its patented designs.

Vertical Tank Inc. filed a complaint on Jan. 26 in the U.S. District Court for the Eastern District of California against BakerCorp alleging patent infringement.

According to the complaint, the plaintiff alleges that it owns several patents regarding hydraulic tank products. The plaintiff alleges the defendant began competing with it in the tank rental business by manufacturing and renting vertical cone bottomed tanks equipped with components nearly identical to the plaintiff's patented products.

The plaintiff requests a trial by jury and seeks judgment for damages, preliminary and permanent injunctions and any such other and further relief as the court may deem just. It is represented by Matthew C. McCartney and N. Thomas McCartney of Eastman & McCartney LLP in Bakersfield and Andrew S. Dallmann of Andrew S. Dallmann PC in San Clemente.
