Consumer accuses collection company of violating TCPA

SAN DIEGO — A San Diego County man has filed a class action lawsuit against Allianceone Receivables Management Inc., alleging violation of the Telephone Consumer Protection Act (TCPA).

D’Anthony Early-Riley filed a complaint, on behalf of himself and all others similarly situated, Feb. 26 in U.S. District Court for the Southern District of California against Allianceone Receivables Management Inc., alleging the collection company violated TCPA through intrusive and unwanted phone calls.

According to the complaint, Early-Riley and other similarly situated recipients have suffered from abuse and harassment, including invasion of their privacy and intrusion on their seclusion, caused by the defendants' unsolicited calls to collect on an alleged debt. Moreover, the calls, in December 2017 and January 2018, were made by illegally using equipment that had the capacity to store or produce telephone numbers. 

The plaintiff alleges Allianceone Receivables Management called with such frequency as meant to abuse or harass, contacted Early-Riley without prior express consent and unlawfully utilized an automatic dialer and automated voice.

Early-Riley seeks trial by jury, statutory damages of $500 for each violation, treble damages of $1,500, an order certifying the case as a class action, appoint Early-Riley as class representative, attorney fees and all other relief the court deems just. The plaintiffs are represented by attorneys Ronald A. Marron, Kas Gallucci and Alexis M. Wood of Law Offices of Ronald A. Marron in San Diego.
