LOS ANGELES — A store clerk is suing Dollar Tree, alleging unpaid wages.
Jimmie Johnson filed a complaint March 1 in U.S. District Court for the Central District of California against Dollar Tree Stores Inc. alleging violation of the Fair Labor Standards Act in failure to compensate employees for all hours worked.
According to the complaint, Johnson worked more than 40 hours per week for Dollar Tree in a non-administrative, executive or professional capacity and spends more than 50 percent of his time in activities not directly or closely related to managerial duties. Johnson says during his employment, he was not provided with proper wages, overtime compensation, and meal and rest periods required for a non-exempt employee.
The plaintiff alleges Dollar Tree Stores failed to properly pay wages, overtime wages, provide meal periods, rest periods and failed to keep written a contract for employment.
Johnson seeks trial by jury, all unpaid wages, all applicable penalties, injunctive relief, costs incurred and all other relief the court deems just and proper. He is represented by attorneys Mike Arias, Alfredo Torrijos and Craig S. Momita of Arias, Sanguinetti, Wang & Torrijos LLP in Los Angeles.
