FRESNO – A Fresno hotel is alleged to have a swimming pool that is not accessible to disabled patrons.
Theresa Brooke filed a complaint on March 22 in the U.S. District Court for the Eastern District of California against Sonny Ahuja and Nagina R. Ahuja, doing business as La Quinta Inn and Suites Fresno Northwest, citing the Americans with Disabilities Act and the California Unruh Civil Rights Act.
According to the complaint, the plaintiff is a wheelchair user. She alleges that on March 19, she went to the defendants' hotel to book a room and saw that the pool lift at the outdoor swimming pool was in disrepair. She alleges because of this, she did not book a room.
The plaintiff holds Sonny Ahuja and Nagina R. Ahuja, doing business as La Quinta Inn and Suites Fresno Northwest, responsible because the defendants allegedly discriminated against the plaintiff because they failed to make its public lodging services fully accessible and independently usable by disabled individuals.
The plaintiff requests a trial by jury and seeks judgment against the defendants, declaratory relief, costs of suit, attorneys’ fees, for damages in an amount no less than $1,000, and other relief the court deems just.
