SAN FRANCISCO – Two individuals allege their former landlords failed to address a mice infestation in the property.

Ian Chan and Winnie Chan filed a complaint on March 14 in the San Francisco County Superior Court against Peggy Pei Qiong Chen, Peter Hon Keung Ling and Does 1-10 alleging negligence, wrongful eviction, tenant harassment, fraud and other counts.

According to the complaint, the plaintiffs rented an upper-level flat on Pacheco Street in San Francisco beginning in 2004. The suit states the defendants resided at the same address on the first floor and also owned the property.

The plaintiffs allege from February 2016 until the end of their tenancy in October 2017, mice infested the property and the defendants did not remedy the infestation.

The plaintiffs hold Chen, Ling and Does 1-10 responsible because the defendants allegedly failed to address tenants' complaints regarding habitability issues, and forced tenants to vacate the unit on misrepresentation that relatives were to move into the property.

The plaintiffs seek judgment against defendants for damages; declaratory and injunctive relief; award general, special, statutory and punitive damages; interest; attorney's fees; expert witness fees; costs; disgorge improper profits; penalties and further relief as the court may deem just.
