Daughter files wrongful death suit against Bristol-Myers Squibb, AstraZeneca Pharmaceuticals

SACRAMENTO – A California woman alleges her mother sustained cardiac injuries as the result of taking two prescription drugs.

Lori Stewart, individually on behalf of the estate of Agnes Stewart, filed a complaint on March 29 in the U.S. District Court for the Eastern District of California against Bristol-Myers Squibb Co. and AstraZeneca Pharmaceuticals LP alleging wrongful death, negligence, failure to warn and other counts.

According to the complaint, the plaintiff alleges that between February and June 2015, Stewart ingested defendants' Onglyza and/or Saxagliptin as part of her diabetes treatment. The plaintiff alleges Stewart developed serious and permanent adverse effects, including but not limited to congestive heart failure in June 2015, because of the use of the drugs. 

The plaintiff holds Bristol-Myers Squibb Co. and AstraZeneca Pharmaceuticals LP responsible because the defendants allegedly failed to adequately warn Stewart of the increased risk of serious injury associated with using Onglyza and Saxagliptin.

The plaintiff requests a trial by jury and seeks judgment for compensatory, general and punitive damages; incidental expenses; prejudgment interest; and for other such and further relief as the court deems just and proper.
