Man alleges Progress Investment Management terminated him after voicing concerns

Wrongful term 06

SAN FRANCISCO – An Alameda County man alleges that his former San Francisco employer terminated him in retaliation over his concerns regarding its practices.

Jason Miles filed a complaint on March 16 in the Superior Court of California - County of San Francisco against Progress Investment Management Co. and Trinet Inc.; and Does 1-50 alleging wrongful termination.

According to the complaint, the plaintiff was hired by Progress in 2011. He alleges that in 2014 he voiced his objections and concerns about defendants' deviations from investment adviser industry "best practices" and regulations. The suit states he was terminated in March 2016 on grounds he alleges were pretextual.

The plaintiff holds Progress Investment Management Co. and Trinet Inc. responsible because the defendants allegedly terminated an employee based on the facts that he reported and objected their plan and actions to disseminate and cause publication of false and misleading statements of material facts to the public.

The plaintiff requests a trial by jury and seeks judgment for general and compensatory damages of no less than $1 million; consequential, special and punitive damages; attorney's fees; costs of suit; and for such other and further relief as the court may deems just and proper. He is represented by Michael T. Welch of Law Offices of Michael T. Welch in San Francisco.
