SAN FRANCISCO – A former waiter for a San Francisco cafe alleges he was forced to resign because of the working conditions.
Gino Hadziomerovic filed a complaint on April 23 in the San Francisco County Superior Court against the Cucagna LTD, doing business as Zuni Cafe, and Does 1-10 citing California Labor Code.
According to the complaint, the plaintiff was employed by the defendants as a waiter from January to November 2016. He alleges he was denied meal and rest periods, overtime pay and sick pay. He also alleges the defendants did not keep accurate accounting of his hours.
The plaintiff holds Cucagna LTD and Does 1-10 responsible because the defendants allegedly denied plaintiff with meal and rest periods as well as overtime and sick pay, failed to provide accurate itemized wage statements and forced plaintiff to resign due to intolerable working conditions.
The plaintiff requests a trial by jury and seeks judgment against defendants for compensatory, general and special damages; attorney's fees; costs of suit; interest; penalties under Labor Code; and other remedy the court deems just.
