Xifin Inc. alleges it is owed more than $700,000 from Texas company

SAN DIEGO – A San Diego health care information technology company alleges it was not paid for services it provided to a Texas company.

Xifin Inc. filed a complaint on May 8 in the U.S. District Court for the Southern District of California against Diagnostic Lab Services LP alleging breach of contract.

According to the complaint, the plaintiff alleges that on Nov. 1, 2016, it entered into a revenue performance management system (RPM) contract with defendant. The plaintiff claims it performed all material terms of the RPM contract but defendant allegedly failed to pay all amounts due under the contract.

The plaintiff holds Diagnostic Lab Services LP responsible because the defendant allegedly failed to pay $540,000 in unpaid minimum service fees due and owing.

The plaintiff requests a trial by jury and seeks judgment for damages in the amount of $706,745.67, plus prejudgment interest, costs of suit incurred, and for such other and further legal or equitable relief as the court deems just and proper.
