Ford Flex owners allege vehicle has excessive wind noise, seeks restitution from auto maker

FRESNO – Two consumers allege a vehicle they purchased has a defect and are seeking restitution from an auto maker.

Raul and Marcella Briones filed a complaint on May 10 in the Fresno County Superior Court against Ford Motor Co. and Does 1-10 citing the Song-Beverly Consumer Warranty Act.

According to the complaint, the plaintiffs allege that on Feb. 9, 2017, they purchased a 2016 Ford Flex from a Ford dealership in Fresno. They allege the vehicle has excessive wind noise and that the defendant's authorized dealers have failed to repair the problem.

The plaintiffs hold Ford Motor Co. and Does 1-10 responsible because the defendants allegedly failed to fully repair plaintiffs' vehicle and failed to provide a replacement or refund plaintiffs' money.

The plaintiffs seek judgment against defendants for actual damages, including collateral charges, and incidental, consequential, and general damages; civil penalty; rescission of the contract and restitution of consideration; interest; attorney's fees; costs of suit; and further relief as the court deems proper. They are represented by Brian J. Bickel and Ronald M. Stewart of The Bickel Law Firm Inc. in San Diego.
