Woman alleges Boise Telecasters partners breached contract

FRESNO – A Playa del Rey resident alleges that business partners in an Idaho TV station breached the contract.

Diane Dostinich, in her individual capacity and derivatively on behalf of Boise Telecasters LP filed a complaint on May 9, in the Fresno County Superior Court against Gary Cocola; Kevin Mosesian; Ginger Lozano; Cocola Broadcasting LLC; Does 1-25 and Boise Telecasters LP alleging breach of fiduciary duty, breach of partnership agreement and other counts.

According to the complaint, the plaintiff alleges that in 2004, she and the defendants formed Boise Telecasters and executed the limited partnership agreement to acquire, own and/or manage the assets and properties required by the Federal Communications Commission of KKJB (TV) Channels 39, Boise, Idaho. 

However, plaintiff claims the defendants "have engaged in a scheme with each other the purpose of which was (and is) to systematically misappropriate assets and usurp opportunities rightfully belonging to Boise Telecasters LP," the suit states.

As a result, Dostinich alleges Boise Telecasters has been prevented from obtaining potential customers and its relationship with current and potential customers has been undermined. 

The plaintiff requests a trial by jury and seeks judgment for compensatory, treble and punitive damages, complete accounting of all monies, award of attorneys' fees, costs, injunctive and declaratory relief, and for such other and further relief as the court deems proper.
