SAN FRANCISCO – Former tenants of a Garfield Street, San Francisco property allege they had to vacate the premises because of the habitability violations.
Sesilia Baca and Darren Buensuceso filed a complaint on May 17 in the San Francisco County Superior Court against Yoav Kiesler, Perl Keren, Stephen Zhang, Saxe Real Estate Management Services Inc. and Does 1-10 alleging negligence, violation of rent ordinance and other counts.
According to the complaint, the plaintiffs entered into a written rental agreement with Kiesler in 2013. The plaintiffs allege the defendants have failed to maintain and repair the unit and allege in February 2014, the bedroom where they slept was flooded by rainwater. The plaintiffs also allege they had further issues with water in the unit and vacated the property in December 2017.
The plaintiffs hold Kiesler, Keren, Zhang, Saxe Real Estate Management Services Inc. and Does 1-10 responsible because the defendants allegedly failed to provide a habitable dwelling, failed to maintain and repair habitability violations in the unit, and failed to keep the premises compliant to standard building codes.
The plaintiffs seek judgment against the defendants for compensatory, general and monetary damages; statutory penalties; declaratory relief; attorney's fees; costs of suit; interest; and further relief as the court deems just.
