Customer claims 365 Auto failed to repair leak in car's roof

FRESNO – A Fresno County consumer alleges that a vehicle she purchased from a dealership has a leaky roof and that it has refused to repair it.

Elaine Sauceda filed a complaint on May 21 in the Fresno County Superior Court against 365 Auto, Premium Auto Credit, Great American Insurance Co. and Does 1 through 50 alleging violation of the Consumer Legal Remedies Act and other counts.

According to the complaint, the plaintiff alleges that in February 2016, she entered into a retail installment sales contact with 365 Auto when she purchased a 2010 Ford Fusion for the total sale price of $22,952.40. In November 2016, the plaintiff claims the vehicle's roof began to leak and she informed 365 Auto of the problem but it allegedly has refused to fix the leaky roof. 

The plaintiff holds 365 Auto, Premium Auto Credit, Great American Insurance Co. and Does 1 through 50 responsible because the defendants materially breached the contract and made misrepresentations about the vehicle in order to induce the plaintiff into purchasing it.

The plaintiff requests a trial by jury and seeks judgment for general damages, rescission of the purchase contract and restitution of all monies expended, punitive and statutory damages, prejudgment interest, and such other and further relief as the court deems proper.
