Man alleges Rural/Metro of San Diego, others attempting to collect invalid debt

SAN DIEGO – A San Diego County man alleges that a collector is attempting to collect an alleged debt he does not owe.

Phillip Franklin filed a complaint individually and on behalf of all others similarly situated on June 1 in the U.S. District Court for the Southern District of California against Rural/Metro of San Diego Inc., Credence Resource Management LLC and Does 1-20 alleging violation of the Fair Debt Collection Practices Act and other counts.

According to the complaint, the plaintiff alleges that Rural/Metro is attempting to collect $113.31 he alleges he does not owe.

The plaintiff holds Rural/Metro of San Diego Inc., Credence Resource Management LLC and Does 1-20 responsible because the defendants allegedly attempted to collect an amount prohibited by law and disregarded knowledge of invalid debts to increase profits.

The plaintiff seeks judgment against defendants; certify class action; award actual, consequential and statutory damages; special damages; injunctive relief; attorney's fees and other relief as the court deems just. He is represented by Joseph Z. Samo and Trevor J. Carroll of Samo Law Group in San Diego.
