Consumer claims JPL Recovery Solutions contacted medical office, sister regarding debt

SACRAMENTO – A Stockton resident alleges a debt collector contacted third parties regarding an alleged debt without her authorization.

Michelle Zapata filed a complaint on June 18 in the U.S. District Court for the Eastern District of California against JPL Recovery Solutions LLC alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the defendant began calling the plaintiff in May to collect an alleged debt. She alleges the defendant left a voicemail and did not identify itself as a debt collector. She also alleges the defendant later contacted Midtown Optometry, the office of her children's physician, and spoke to employees there without her consent and also contacted her sister.

The plaintiff holds JPL Recovery Solutions LLC responsible because the defendant allegedly engaged in conduct with intent to harass, oppress, or abuse; caused plaintiff’s telephone to ring repeatedly to annoy; and disclosed information regarding plaintiff's alleged debt to a third-party.

The plaintiff requests a trial by jury and seeks judgment against defendant for actual and statutory damages, costs of litigation, attorney's fees, and all other relief as the court deems just. She is represented by Abbas Kazerounian, Mona Amini and Ali Reza Sadrarhami of Kazerouni Law Group APC in Costa Mesa and Joshua B. Swigart of Hyde & Swigart in San Diego.
