FRESNO – A man alleges two companies failed to install a solar system per the terms of a contract.
Ruben Macedo filed a complaint on June 7 in the Fresno County Superior Court against Myers Life Solutions Inc., Solar Engine LLC, Greensky of Georgia LLC and Does 1-20 alleging breach of contract and other counts.
According to the complaint, the plaintiff alleges that on June 11, 2016, a representative of Greensky and Myers approached him at the home he was residing in and asked if he wanted to lower his electricity bill. He alleges the conversation was conducted in Spanish and that he was presented a contract and loan documents in electronic form, which he signed.
The plaintiff alleges at no point in the conversation did the representative disclose he was signing for the installation of solar panels. He alleges he was under the impression the offer was through his local utility provider.
The suit states a solar system was partially installed and never completed.
The plaintiff holds Myers Life Solutions Inc., Solar Engine LLC, Greensky of Georgia LLC and Does 1-20 responsible because the defendants allegedly failed to provide a contract to him in Spanish and failed to perform the terms of the contract.
The plaintiff seeks judgment against defendants for damages, restoration of property, rescission of the loan and contract, attorney's fees, costs of suit and other damages or awards that the court deems proper. He is represented by Stephen Labiak of Law Offices of Stephen Labiak in Fresno.
