Motorist seeks damages from Morning Star Trucking, driver over alleged injuries caused by blown-out tire

FRESNO – A driver alleges he and his vehicle were injured by a blown-out tire on Interstate 5.

Eduardo Valesca filed a complaint on June 15 in the Fresno County Superior Court against Deshawn Wharry, Morning Star Trucking Co., and Does 1 to 50 alleging negligence.

According to the complaint, on Aug. 3, 2017, plaintiff was traveling northbound on Interstate 5 just south of Derrick Avenue in Cantua Creek. The suit states a portion of a blown-out tire on a Morning Star vehicle, which was operated by Wharry, was hurled toward his vehicle and caused injuries to his vehicle and body.

The plaintiff alleges the defendants allegedly violated statutes relating to the safe operation of a vehicle.

The plaintiff requests a trial by jury and seeks judgment for general and special damages, medical and health care expenses, costs, prejudgment interest, and for such other and further relief as the court may deem just and proper.
