Surviving heirs claim man died due exposure to asbestos, seek damages from Kelly-Moore Paint and others

SAN FRANCISCO – The surviving spouse and adult children of a man who died of lung cancer allege his cancer was caused by exposure to asbestos during his career.

Billie Belmer, as successor-in-interest to and as wrongful death heir of Donald Belmer, deceased; and Kathleen Belmer and James Belmer, as wrongful death heirs of the deceased, filed a complaint on Oct. 10, in the San Francisco Superior Court against Kelly-Moore Paint Co. Inc., Metropolitan Life Insurance Co., Grinnell LLC, et al. alleging negligence, products liability and other counts.

According to the complaint, in May 2018, Donald Belmer was diagnosed with lung cancer and asbestosis as a result of being exposed to asbestos-related products. The suit states he was diagnosed with asbestos-related pleural disease in 1995. He died May 20 of lung cancer, the suit states.

The suit states Donald Belmer was exposed to asbestos during his career, which included locations in Michigan and California.

The plaintiffs hold Kelly-Moore Paint Co. Inc., Metropolitan Life Insurance Co., Grinnell LLC, et al. responsible because the defendants allegedly defectively designed asbestos and asbestos-containing products and failed to adequately warn of the potential safety hazards of asbestos and asbestos-containing products.

The plaintiffs seek judgment for damages, expenses, loss of support, costs of suit, and for such and further relief as the court may deem just and proper. They are represented by Alan R. Brayton, David R. Donadio, James P. Nevin and Nancy T. Williams of Brayton & Purcell LLP in Novato.
