SAN FRANCISCO – An insurance company is seeking damages from the driver an owner of a car over a San Francisco collision that injured a worker.
Applied Risk Services Inc. for California Insurance Co. filed a complaint on Dec. 3 in the San Francisco Superior Court against Nancy Veronica Huerta and Jose Luis Castellano Zepeda alleging negligence.
According to the complaint, on Dec. 5, 2016, Eric Rappold was working within the course and scope of his employment for Munchery Inc. and was driving at 17th Street near Church Street in San Francisco when his vehicle was struck by Huerta, who was driving a vehicle owned by Zepeda.
As a direct and proximate result, the suit states the plaintiff has been obligated to pay workers' compensation benefits to Rappold.
The plaintiff holds Huerta and Zepeda responsible because Huerta allegedly failed to yield while making a left turn.
The plaintiff seeks judgment for compensatory damages according to proof. It is represented by Christopher J. Capalbo of Siegel, Moren & Stettler APC in San Diego.
