Gallagher Bassett Services seeks reimbursement of workers' compensation claim from company

FRESNO – A claims services provider is seeking reimbursement from a company for a workers' compensation claim.

Gallagher Bassett Services Inc., for Concrete Value Corp. as real party in interest, filed a complaint on Dec. 5 in the Fresno County Superior Court against Fleming and Sons Concrete Pumping Inc. alleging negligence and seeking subrogation.

According to the complaint, the plaintiff alleges it became obligated to pay and has paid workers' compensation benefits to Concrete Value Corp.'s employee, Miguel Bautista, as a result of the negligence of the defendant. The suit states on Dec. 9, 2016, the defendant operated its concrete pump in such a manner that its hose struck and severely injured Bautista.

The plaintiff seeks reimbursement of all workers' compensation benefits paid on Bautista's behalf.

The plaintiff seeks judgment against the defendant for compensatory damages according to proof. It is represented by Christopher J. Capalbo of Siegel, Moreno & Stettler APC in San Diego.
