Man blames forklift at CVS location for fall, alleged injuries

SAN FRANCISCO – A man alleges a forklift at a CVS in San Francisco caused him to fall.

Rey Benavidez filed a complaint on Jan. 4 in the San Francisco Superior Court against CVS Pharmacy Inc., Kent Jeffrey and Does 1 to 10 alleging negligence.

According to the complaint, on June 26, 2017, Benavidez was walking on a public sidewalk at a CVS in San Francisco owned by Jeffrey when he tripped and fell due to a forklift and was injured. 

The plaintiff holds CVS Pharmacy Inc., Jeffrey and Does 1 to 10 responsible because the defendants allegedly created a dangerous condition by leaving a forklift on a public sidewalk and failed to give warning of the condition.

The plaintiff seeks judgment for compensatory damages, costs of suit, and such relief as is fair, just and equitable. He is represented by Michael Patrick Rooney in San Francisco.
