Andy's BP, Self-Serve Petroleum alleged to have failed to provide meal, rest periods

SAN FRANCISCO – Former employees of San Francisco companies allege they were not provided proper meal and rest periods during their employment as gas station attendants.

Corrine Lashbrook and Joshua Sweat filed a complaint on behalf of themselves and all others similarly situated and the general public on Jan. 2 in the San Francisco County Superior Court against Andy's BP Inc., Self-Serve Petroleum Inc., Andy Saberi, Thomas I. Saberi and Does 1-50 alleging violation of California labor codes.

According to the complaint, the plaintiffs were employed by the defendants as gas station attendants from 2011 to September 2018 when they were allegedly terminated without cause.

They also allege the defendants failed to provide proper meal and/or rest periods, overtime wages and accurate wage statements.

The plaintiffs hold the defendants responsible because the defendants allegedly failed to pay additional wages for meal and/or rest periods not taken or provided, failed to provide timely paid final wages, failed to reimburse employees for business-related expenses, and failed to provide all overtimes wages earned.

The plaintiffs request a trial by jury and seek judgment against defendants, certify class action, award unpaid wages, actual, statutory and liquidated damages, restitution, declaratory and injunctive relief, equitable relief, interest, statutory penalties, costs of suit, interest, attorneys' fees, and other relief as the court deems just. They are represented by Erik J. Christensen of Diamond Baker Mitchell LLP in Nevada.
