Lawyer who whiffed on lawsuit over Subway tuna subs now claims Philz Coffee's gluten free products contain gluten

A Santa Monica attorney, previously accused of misleading a court in a notorious lawsuit alleging that Subway's tuna sandwiches lack actual tuna, has returned to the courtroom, now spearheading a class action lawsuit asserting that the gluten-free products at Philz Coffee actually contain gluten.

On Jan. 29, attorney Shalini Dogra, of Dogra Law Group, filed a class action lawsuit in San Francisco County Superior Court against Philz Coffee.

The lawsuit was filed on behalf of named plaintiff Ayaunna Martinez, of San Francisco.

The lawsuit accuses Philz, which operates locations throughout San Francisco and elsewhere in California, of allegedly misleading consumers by allegedly selling a line of food products they claim are gluten free, but which actually contain gluten.

The lawsuit asserts this allegedly violates California consumer protection and fraud laws, among other counts.

The lawsuit seeks unspecified compensatory, statutory and punitive damages, plus attorney fees.

The Philz lawsuit marks one of the latest consumer fraud lawsuit forays in court for Dogra. She famously was forced to withdraw a class action lawsuit against Subway in 2023, in which she represented a plaintiff who claimed the sandwich chain sold tuna sandwiches which did not actually contain tuna.

Dogra was accused of lying to the court in that case.
