Yahoo seeks non-infringement declaration

SAN JOSE, Calif. – Yahoo is suing a Swiss company and a subsidiary in a complaint and is seeking declaration of non-infringement for seven patents.

Yahoo Inc. filed a complaint for declaratory judgment Jan. 21 in the U.S. District Court for the Northern District of California, San Jose Division against Kudelski SA and OpenTV.

According to the claim, the U.S. Patents in question are Nos. 7,409,437; 6,233,736; 7,055,169; 7,028,327; 7,752,642; 6,758,754; and 6,148,081. Yahoo alleges that Kudelski sent a notice of infringement letter Dec. 22 in regards to Yahoo’s branded mobile applications and Yahoo’s Connected TV. According to the information in the case, OpenTV, a Kudelski subsidiary, owns the patents.

Yahoo is seeking, in a jury trial, a declaration stating that the manufacture, use, offer for sale, sale, and/or importation of its mobile applications and Connected TV does not infringe on the patents in question. Daralyn J. Durie, Clement S. Roberts and Laura E. Miller of Durie Tangri LLP of San Francisco will represent the plaintiff.
