Malibu Media takes file-sharer to court over alleged copyright infringement

SAN FRANCISCO — Malibu Media LLC is suing an unknown individual under their IP address for uploading copyrighted content through BitTorrent.

The California limited liability company, in association with X-Art.com, filed a lawsuit on Dec. 27, 2015, in the Northern District of California District Court against John Doe, who has the subscriber assigned IP address 174.62.72.81 for direct copyright infringement.

According to the suit, the defendant copied and distributed a complete copy of one of Malibu Media’s work by using BitTorrent, which is a file distribution network through peer-to-peer sharing. Through Malibu Media’s investigation with Excipio GmbH, they downloaded pieces of the digital media files, the suit states. Reproduction and redistribution for sale or other transfers of ownership are in violation of the United States Copyright Act of 1976.

Through a jury trial, Malibu Media is seeking an order from the court to permanently remove and delete the media files in question and statutory damages. Brenna E. Erlbaum and Brian Heit of Heit Erlbaum LLP in Newbury Park will represent the plaintiff.
