Suit filed against California couple seeking balance of allegedly unpaid loan

SAN FRANCISCO – A Mississippi couple is suing a California couple alleging that a loan remains unpaid.


Andrew Lockhart and Lesley Lockhart filed a complaint on March 31 in the U.S. District Court for the Northern District of California against Jay R. Delaney, Kathleen M. Delaney and Does 1 through 25, citing breach of contract.

According to the complaint, the plaintiffs allege that in 2002, they provided a loan for $205,000 with a monthly interest payment of $769 per month to the defendants, and that the principal balance was due by June of 2007. However, plaintiffs were never paid in full for this loan despite of multiple attempts to collect, the suit states. The plaintiffs holds Jay R. Delaney, Kathleen M. Delaney and Does 1 through 25 responsible because the defendants allegedly failed to honor their agreement with the plaintiffs by failing to pay the total loan by the due date. Even after the plaintiffs filed an action in 2014, the suit states, the defendants failed to make any payments based on the settlement both parties agreed to.

The plaintiffs seek the sum of $153,068.67 plus interest and other charges according to proof, declaring the existence of an equitable mortgage encumbering the property referenced in this complaint, all damages, all legal fees and any other relief as this court deems just. They are represented by Jamil L. White and Michael D. Maloney of Louis White, Professional Law Corp. in Sacramento.
