B Side Inc. alleged to have breached bargaining agreement

SAN FRANCISCO – Several labor unions have filed a suit against a business alleging it has not paid contributions per their bargaining agreement.

District Council 16 Northern California Health and Welfare Trust Fund and its joint board of trustees; Bay Area Painters and Tapers Pension Trust Fund, and its joint board of trustees et al., filed a complaint on April 8 in the U.S. District Court for the Northern District of California against B Side Inc. and Anton Kalafati, citing breach of bargaining agreement.

According to the complaint, the plaintiffs allege that between Jan. 1, 2011, and Oct. 31, 2014, they suffered damages as a result of delinquent payment of contributions. The plaintiffs hold B Side Inc. and Kalafati responsible because the defendants allegedly failed and refused to pay contributions on behalf of its employees to the board of trustees as per the bargaining agreement.

The plaintiffs seek unpaid contributions, liquidated damages on all late paid and unpaid contributions, all legal fees and any other relief as the court deems just. They are represented by Michele R. Stafford and Timothy A. Froehle of Saltzman & Johnson Law Corp. in San Francisco.
