North American Co. for Life and Health Insurance seeks rescission of policy

SACRAMENTO – An insurance firm is seeking a rescission on a life insurance policy from the court over claims the late policy owner omitted medical information on the application.

North American Co. for Life and Health Insurance filed a complaint for rescission on April 15 in the U.S. District Court for the Eastern District of California against Suvin Xiong.

According to the complaint, the plaintiff alleges that on Feb. 20, 2013, it issued a life insurance policy to Tong Lor that listed Xiong as the beneficiary. The suit states that Lor died in October 2014 and Xiong made a claim on the policy that December.

The plaintiff alleges that Lor's medical records showed that she had several medical conditions which she denied when she filled her application form for insurance benefits. Because of this, the plaintiff denied the claim and issued a refund of $1,406.32, the suit states.

The plaintiff seeks rescission of the policy, judgment that Policy No. LB02619990 is null and void, an order for the policy to be delivered and surrendered for cancellation and any other relief as this court deems just.
