Man alleges disability benefits were wrongfully terminated

Insurance 10

SAN FRANCISCO – A former Ralcorp Holdings employee alleges his disability benefits were wrongfully terminated.

Kamal Singh filed a complaint on Jan. 29 in the U.S. District Court for the Northern District of California against Hartford Life and Accident Insurance Co., citing violation of the Employee Income Retirement Security Act.

According to the complaint, the plaintiff alleges that on Oct. 21, 2011, he was found to be disabled under the terms of the plan and was initially approved for long-term benefits. The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the defendant allegedly terminated plaintiff's insurance benefits in May 2015 despite having sufficient supporting documents stating that he is still disabled.

The plaintiff seeks an order that the defendant pay disability benefits to plaintiff from May 16, 2015, until date of judgment is rendered, future disability benefits, interest, all legal fees and any other relief as this court deems just. He is represented by Brian H. Kim and James P. Keenley of Bolt Keenley Kim LLP in Berkeley.
