Man alleges RV is defective

SAN FRANCISCO – A Grass Valley man alleges that an RV he purchased has numerous defects that have not been repaired.

Mervin Swanson filed a complaint on April 19 in the U.S. District Court for the Northern District of California against Keystone RV Co. Inc. and James B. Tuck Enterprises Inc. citing alleged breach of implied warranty and breach of warranty.

According to the complaint, the plaintiff alleges that on Sept. 19, 2015, he purchased an RV that has defects. The plaintiff holds Keystone RV Co. Inc. and James B. Tuck Enterprises Inc. responsible because the defendants allegedly failed to fix the defects in plaintiff's RV, making it useless and putting it out of service.

The plaintiff requests a trial by jury and seeks contract be adjudged rescinded, restitution, all damages, interest, civil penalty of two times plaintiff's actual damages, all legal fees and any other relief as this court deems just. He is represented by Terry L. Baker in Capitola.
