SAN FRANCISCO – Several union trust funds have filed suit against a utility company over allegations of unpaid contributions.
Operating Engineers' Health and Welfare Trust Fund for Northern California; Pension Trust Fund for Operating Engineers; Pensioned Operating Engineers' Health and Welfare Trust Fund; et al. filed a complaint on April 21 in the U.S. District Court for the Northern District of California against P&J Utility Co. citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that P&J Utility Co. has failed and refused to pay contributions to the trust funds on behalf of its employees for February and March. They also allege contributions were not paid in 2012, 2014 and 2015.
The plaintiffs seek any unpaid contributions, liquidated damages on all late paid and unpaid contributions, interest, all legal fees, and any other relief as this court deems just. They are represented by Michele R. Stafford and Erica J. Russell of Saltzman & Johnson Law Corp. in San Francisco.
