Sun Life Assurance accused of wrongfully denying benefits

SAN FRANCISCO – A former Calera employee alleges she was wrongfully denied long-term disability benefits.

Elvia Tahara filed a complaint on April 20 in the U.S. District Court for the Northern District of California against Sun Life Assurance Co. of Canada, citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in April 16, 2015, she became disabled under the terms of the plan while the plan was in full effect but was wrongfully denied benefits. The plaintiff holds Sun Life Assurance Co. of Canada responsible because the defendant allegedly denied plaintiff's claims for long-term disability benefits despite being disabled under the terms of the plan and adequate medical evidence sent by the plaintiff.

The plaintiff seeks an order for the defendant to pay disability benefits owed to her from July 16, 2015, through the date of judgment plus interest, declare plaintiff's rights to receive future benefits, prohibit the defendant from terminating or reducing plaintiff's benefits, reinstatement of plaintiff's benefits, all legal fees, interest, and any other relief as the court deems just.
