Flowers Baking Co. facing suit from distributor

SACRAMENTO – A distributor for a bakery alleges he was treated like an employee instead of an independent contractor.

Donald Johnson filed a complaint on April 22 in the U.S. District Court for the Eastern District of California against Flowers Baking Co. of California LLC and Does 1 through 100, citing violations of California business and labor codes.

According to the complaint, the plaintiff alleges that he was deceived into entering into an agreement to buy the distribution rights of the defendant's products and was treated as an employee rather than an independent contractor. The plaintiff holds Flowers Baking Co. of California LLC and Does 1 through 100 responsible because the defendants allegedly made false interpretations to plaintiff and failed to reimburse him all the necessary work-related expenditures incurred.

The plaintiff requests a trial by jury and seeks all damages, disgorgement and injunctive relief; compensatory, exemplary and statutory damages; and any other relief as the court deems just. He is represented by Matthew Mellen and Jessica Galleta of Mellen Law Firm in San Mateo.
