Funds allege Cool Breeze Refrigeration Inc. owes contributions

SAN FRANCISCO – A pension fund and a trust fund are suing a Reno, Nevada-based business over allegations it breached the bargaining agreement between the two parties.

Trustees of the U.A. Local 393 Pension Fund and the U.A. Local 393 Health and Welfare Trust Fund filed a complaint on April 26 in the U.S. District Court for the Northern District of California against Cool Breeze Refrigeration Inc., citing violation of the Employee Income Retirement Security Act.

According to the complaint, the plaintiffs allege that since September 2015 they suffered damages because the defendant did not pay its monthly contributions on behalf of its employees. The suit states the defendant submitted a monthly report for the total amount owing but did not pay the amount owing for that month.

The plaintiffs seek all damages, all fringe benefit contributions, liquidated damages plus interest, all legal fees and any other relief as the court deems just. They are represented by Mark S. Renner of Wylie, McBride, Platten & Renner in San Jose.
