Man files suit for pension benefits

SAN FRANCISCO – A Novato man has filed suit against the holders of a pension plan alleging that they denied plaintiff's claim for early pension.

John J. O'Rourke filed a complaint on April 15 in the U.S. District Court for the Northern District of California against Northern California Electrical Workers Pension Plan and board of trustees of the Northern California Electrical Workers Pension Trust citing violation of the Employee Income Retirement Security Act.

According to the complaint, the plaintiff alleges that in August 2014 he applied for early pension benefits but was denied in March 2015. The plaintiff holds Northern California Electrical Workers Pension Plan and Board of Trustees of the Northern California Electrical Workers Pension Trust responsible because the defendants allegedly denied plaintiff's application for an early pension several times without discussion and have violated the terms of the plan.

The plaintiff seeks order to pay plaintiff his early pension benefits from Oct. 1, 2014, until judgment plus interest on each and every month, all legal fees and any other relief as the court deems just. He is represented by Teresa S. Renaker, Margaret E. Hasselman and Kirsten Scott of Renaker Hasselman LLP in San Francisco.
